Local Law 97 Compliance for NYC Buildings.

In 2019, New York City enacted Local Law 97 (LL97) to help reduce greenhouse gas emissions. The law requires buildings over 25,000 square feet to reduce carbon emissions by 40% by the year 2030 and 80% by 2050.

LL97 is one of the most ambitious climate laws in the country and requires the management and coordination of an expert.  If your property is affected by Local Law 97, Energo can help.

Navigating Local Law 97.

New York City’s Local Law 97 sets annual greenhouse gas (GHG) emissions limits for buildings 25,000 square feet and greater beginning in 2025. A buildings’ GHG limits are a function of the building space use type(s) coupled with corresponding square footages.

Local Law 97 (LL97) requires annual filing regardless of whether a building is above or below its GHG limits, for both initial reporting periods, 2024-2029 and 2030-2034.

The reporting deadline for the LL97 2025 reporting year is May 1, 2025, however, building owners that need more time to file reports can file an LL97 extension request until August 29, 2025 (previously June 30) which would extend the LL97 reporting deadline to December 31, 2025.

While most buildings may be under their 2024 GHG limits, GHG limits drop for the 2030 reporting period. It is estimated roughly 80% of buildings are over their 2030 GHG limits making it important to begin planning now.

Local Law 97 Fines.

Buildings that fail to comply will be subject to massive fines per month for failing to file on time. In addition, if your building exceeds its assigned emissions limit, you could face annual fines.

  • Failure to File a Report: $0.50 per building square foot, per month. For example, a 100,000 sq. ft. building would be $50,000 per month.
  • Exceeding Emission Limits: $268 for each metric ton over the building’s established limit. For example, a 100,000 sq. ft. multifamily residential building emitting 800 metric tons of carbon would be 145 metric tons over its 2024-2029 targets and pay a fine of $38,860.
  • Providing False Statements: $500,000 fine
